The Government has introduced new legislation that is due to come into effect in October 2007 and after that date, unless you have an existing EPA, you will be obliged to use the new lengthy form of Lasting Power of Attorney. The new regime will be expensive to implement and include a mandatory registration application with the Court of Protection and a fee of over £100. The proposals are not only onerous, but by their nature will incur significant legal costs.
