Godwins are adept at providing prompt and cost-effective solutions that resolve contentious matters. In response to the recent evolution of contentious law cases and procedural rule changes, we offer our clients a variety of options that do not involve the traditional court process. We are sensitive to the fact that such matters can be distressing, both personally and commercially.
If going to court becomes unavoidable, clients can draw on a depth of knowledge and experience that has seen the Head of our Litigation Department represent clients all the way up to the House of Lords (now the Supreme Court).

We also have expertise in advising on the highly complicated area of chancel repair liability and have advised both landowners and institutions on the subject.

We are able to advise on all methods of dispute resolution. Whether by simply talking matters through, by correspondence with the other side or if necessary, a more formal approach that may involve mediation or arbitration as an alternative to court action.
Contentious Trust and Probate Matters
Godwins is home to one of the region’s leading private client teams. In recent years we have advised extensively on both trust and probate matters that have had a contentious element. We have considerable experience in advising on high value probate and trust matters and we always seek to bring a pragmatic approach to matters in our care.
We advise executors, beneficiaries of Wills or trusts and third parties. Many people involved in these matters will face difficult decisions throughout the process and we are often requested to advise on practical matters as well as any legal implications. As with all contentious matters, this area has recently seen an increase in approaches that do not involve court proceedings and we are well equipped to advise and act accordingly.
Recovery of Debts & Assets
We offer a fast and attentive service in the resolution of matters relating to asset and debt recovery. Recent economic uncertainty has led to an increase in such issues and we have responded by helping our clients handle matters in a prompt but satisfactory manner, whatever the circumstances.
